Reservly Geographic Availability

The short version
Reservly is generally available globally, with a short list of excluded regions below. The exclusions reflect US sanctions, data-localisation law, and Reservly's own operational decisions. The list may change over time.

1. Where Reservly is available
Reservly is offered to businesses and end users in the vast majority of countries and territories worldwide. Our data-protection framework (see Privacy Policy § 9 and the Data Processing Agreement) covers transfers of personal data from any region to our US-based infrastructure, using Standard Contractual Clauses, UK Addendum, Swiss amendments, or Data Privacy Framework certifications as applicable.
Specific national laws may add additional obligations for businesses or end users in those jurisdictions; see the region-specific sections of the Privacy Policy (§§ 9.2–9.16).
2. Where Reservly is NOT currently available
The Service is not offered in, and may not be used by businesses established in, or end users resident in, the following regions:
OFAC / international sanctions
- Russia
- Iran
- North Korea (DPRK)
- Syria
- Cuba
- Crimea, Donetsk, Luhansk, and Zaporizhzhia regions of Ukraine (as those regions are defined by US OFAC and EU sanctions at the time of signup)
Data-localisation and regulatory requirements incompatible with current infrastructure
- Mainland China (mainland PRC; Hong Kong and Macau are separately available)
- Vietnam — Vietnam's Personal Data Protection Decree (PDPD) imposes data-localisation requirements that conflict with Reservly's current non-local infrastructure. Excluded pending a compliant local-infrastructure solution.
- Egypt — Egypt's Personal Data Protection Law 151/2020 requires a government-issued data-controller licence from the PDPC before any personal data of Egyptian residents may be processed. Reservly has not yet obtained this licence. Excluded pending licensing assessment.
- Bangladesh — Excluded per Reservly's operational assessment of local data-handling requirements and infrastructure compatibility.
- Thailand — Excluded pending compliance assessment of Thailand's Personal Data Protection Act B.E. 2562 (2019) and applicable tourism-sector licensing requirements (Tourism Business and Guide Act B.E. 2551). Thai tour operators may use Reservly once Reservly's Thailand compliance programme is complete; see § 4A.1.
Language-compliance requirements
- Quebec, Canada — Quebec's Charter of the French Language (as amended by Bill 96, in force June 1, 2022) requires software interfaces and consumer contracts to be available in French. Reservly's platform is currently English-only. Quebec-resident businesses and their customers are excluded until French-language versions are published. Other Canadian provinces (Ontario, British Columbia, Alberta, etc.) are fully available.
Reservly's operational decisions
- Israel — Excluded by Reservly's operational decision. This is NOT based on active
US, EU, or UN sanctions designations against Israel. Contact
support@reservly.iowith subject line "Geographic availability" for a case-by-case review.
Exclusions are enforced as described in § 4 below.
3. Why these regions are excluded
- Sanctions-based: Russia, Iran, North Korea, Syria, Cuba, and the occupied Ukrainian regions (Crimea, Donetsk, Luhansk, Zaporizhzhia) are excluded based on US OFAC sanctions and aligned EU/UK sanctions designations.
- Data-localisation / regulatory licensing: Mainland China (data sovereignty laws), Vietnam (PDPD data-localisation), Egypt (PDPC government-licence prerequisite), Bangladesh (operational assessment), and Thailand (PDPA compliance programme in progress) are excluded because their local requirements are not yet met by Reservly's current infrastructure or compliance programme.
- Language compliance: Quebec is excluded because Reservly's English-only platform does not yet meet Quebec's French-language mandate under the Charter of the French Language.
- Operational decision: Israel is excluded by Reservly's own business decision, not by any legal obligation.
4. What happens if you try to access from an excluded region
- Marketing site visits.
reservly.iomay still load, but signup will not complete. This is so that someone outside an excluded region who is travelling temporarily through one can still research the product. - Existing accounts logging in from a temporary trip. A single login from an excluded region, where the account's primary operations are based elsewhere, will normally pass without issue. Repeated logins, or clear relocation, will prompt a review.
- New signups. Blocked at the subscription step.
- Bookings through an existing Business's page. Whether an end user in an excluded region can complete a booking depends on the Business's configuration and the payment provider. We do not prevent end users from reading a booking page; payment providers may block the payment.
4A. Jurisdiction-specific obligations for Businesses
Reservly being available in your country does not mean you have all necessary permits or licences to operate your business in that country using Reservly. The following notes are informational and not exhaustive; you are responsible for understanding and complying with all laws applicable to your business.
4A.1 Tourism operators — Thailand
Thailand is currently excluded from Reservly's available markets pending compliance assessment of Thailand's Personal Data Protection Act and tourism-sector licensing requirements (see § 2). This advisory will apply when Reservly's Thailand compliance programme is complete.
Thailand's Tourism Business and Guide Act B.E. 2551 (2008) requires businesses operating as tour operators or travel agencies in Thailand to hold a licence from the Tourism Authority of Thailand (TAT). This includes businesses offering guided tours, inbound or outbound travel packages, or similar tourism services to paying customers. Once Reservly is available in Thailand, operating without the required TAT licence is a matter between your business and Thai authorities. Reservly does not verify TAT licence status and does not accept liability for unlicensed operations.
If you are a Thai-resident business or operate tours primarily to or within Thailand and are uncertain whether your activities require TAT licensing, consult a licensed Thai law firm or contact the Tourism Authority of Thailand directly (tourism.go.th).
4A.2 Payment-provider restricted categories
If you plan to accept payments through Reservly's Stripe or PayPal integration, additional category restrictions apply beyond this geographic list. Stripe publishes a Restricted Businesses list at stripe.com/legal/restricted-businesses; PayPal publishes equivalent restrictions in its Acceptable Use Policy. Connecting a Stripe or PayPal account to Reservly without having any required approvals from those providers is a breach of the Terms of Service § 8.1.
Businesses offering tourism services (guided tours, boat trips, kayaking, safaris, and similar operator-led experiences) should be aware that Stripe classifies "travel reservation services" as a restricted category. The restriction targets travel agencies brokering third-party inventory (flights, hotels) rather than operators selling their own services — but if you describe your business as a "travel agency" or "OTA," confirm with Stripe before activating payment processing through Reservly. See Terms of Service § 8.1 for the cross-reference.
4A.3 Tourism operator licensing — Kenya, Tanzania, and South Africa
Reservly's booking platform is available in Kenya, Tanzania, and South Africa and supports tourism-operator use cases including safari operators, lodge and resort bookings, eco-tourism, beach resort experiences, and guided tour scheduling.
Kenya. Businesses providing tourism services in Kenya (tour operators, travel agents, accommodation providers, and guides) are regulated by the Tourism Regulatory Authority (TRA) under Kenya's Tourism Act 2011. Tour operators and travel agents must hold a TRA licence (categories A, B, or C depending on service scope). Operating without a valid TRA licence exposes your business to fines and closure orders from the TRA. Contact: tourism.go.ke. Reservly does not verify TRA licence status.
Tanzania. Businesses offering tourism services in Tanzania (tour operators, wildlife lodges, Kilimanjaro/Serengeti guides, Zanzibar hospitality) must register with the Tanzania Tourist Board (TTB) and hold a TTB licence appropriate to their service category. Contact: tanzaniatourism.go.tz. Reservly does not verify TTB licence status.
South Africa. Tourism accommodation establishments in South Africa are graded by the Tourism Grading Council of South Africa (TGCSA), which is optional but widely expected by the market. Tour operators may need registration with the Association for Tourism and Leisure Education and Training (THETA) or a provincial tourism authority depending on service type. For inbound tour operators, contact South African Tourism at southafrica.net or the Department of Tourism at tourism.gov.za.
Using Reservly to manage bookings for an unlicensed tourism operation in these countries is a matter between your business and the relevant authority. Reservly does not accept liability for unlicensed operations.
4A.4 Latin American data-registration obligations
Several Latin American countries require data controllers to register their use of personal data with a national authority. If you are a business using Reservly in any of the following countries, you (as the controller of your customers' booking data) may have an independent registration obligation — separate from anything Reservly registers on its own behalf:
- Argentina: National Register of Databases, administered by the AAIP (aaip.gob.ar)
- Colombia: Registro Nacional de Bases de Datos, administered by the SIC (sic.gov.co)
- Peru: National Register of Personal Data Banks, administered by the ANPDP (gob.pe/anpdp)
- Uruguay: URCDP database register (datospersonales.gub.uy)
Failure to register can result in fines assessed against your business by the relevant authority. Reservly does not register on your behalf. Consult local counsel or the relevant authority website for registration requirements applicable to your specific business.
4A.5 Mexico — aviso de privacidad requirement
If you are a Mexican business, Mexico's Ley Federal de Protección de Datos Personales en Posesión de los Particulares requires you to provide your customers with a formal aviso de privacidad (privacy notice) in Spanish at the point of data collection. This is a separate document from Reservly's Privacy Policy — it must describe your business as the data controller and your customers' rights under Mexican law. INAI (inai.org.mx) provides templates. Reservly's booking form currently collects customer name, email, phone, and booking details on your behalf; you are responsible for ensuring your customers receive a compliant aviso covering that data collection.
4A.6 Brazil — consumer withdrawal right for digital subscriptions
Brazil's Consumer Defence Code (CDC, Lei 8.078/90 Art. 49) gives consumers a 7-day right of withdrawal on digital service subscriptions. For end-user customers who book through your Reservly-hosted page and pay through your connected Stripe or PayPal account, you (the business) are the merchant of record and are responsible for your own cancellation and refund policy under Brazilian consumer law. Reservly's cancellation-policy configuration tool does not automatically generate a CDC-compliant policy. Brazilian businesses should configure their cancellation policy (or consult local counsel) to ensure it meets CDC requirements.
4A.7 Data controller registration — African jurisdictions
Several African countries require data controllers (including foreign SaaS platforms processing data of their residents) to register with the national data-protection authority before processing begins. This is a separate obligation from your GDPR or CCPA compliance. If you are a business established in, or primarily serving customers in, the following countries, be aware of your country's data controller registration requirements:
- Kenya — Register with the Office of the Data Protection Commissioner (ODPC) before processing Kenyan personal data. odpc.go.ke
- Nigeria — Data Controllers of Major Importance must register with the Nigeria Data Protection Commission (NDPC). Threshold: processing >2,000 data subjects/month. ndpc.gov.ng
- Ghana — Register with the Data Protection Commission (DPC). dataprotection.org.gh
- Tanzania — Register with the Personal Data Protection Commission (PDPC).
- South Africa — Appoint and register your own Information Officer with the Information Regulator under POPIA. inforegulator.org.za
- Morocco — Register processing activities with the CNDP before commencing. cndp.ma
- Egypt — Obtain a data-controller licence from the Personal Data Protection Centre (PDPC) before processing Egyptian personal data. This is a mandatory prerequisite, not a simple registration.
Reservly's DPA provides the EU Standard Contractual Clauses and data-protection infrastructure these registrations will reference. Your registration as a business data controller is your own obligation; Reservly is the data processor for your customers' booking data.
5. Quebec French-Language Requirements
Reservly is not currently available to Quebec-resident businesses or their customers (see § 2). This section explains the language compliance requirements that would need to be met before Quebec can be added to Reservly's available markets.
Quebec's Charter of the French Language (as amended by Bill 96, in force June 1, 2022) requires:
- Consumer contracts — including Terms of Service and Privacy Policy — must be available in French before a Quebec consumer is asked to agree to them.
- Software and web interfaces must be available in French.
- Communications with Quebec consumers must be in French by default.
Reservly's platform, Terms of Service, Privacy Policy, and all 14 legal pages are currently in English only. Reservly is evaluating French translations as part of a planned Quebec market entry programme.
If you are a business operator who is interested in Reservly becoming available in Quebec,
email support@reservly.io with subject line "Quebec market interest". When French
translations are published, the Quebec exclusion will be removed and this section will be
updated with links to the French versions.
6. If you believe you are blocked in error
Email support@reservly.io with subject line "Geographic block query". Include:
- the country you are based in;
- a brief description of what happened (what step was blocked);
- if you are travelling or temporarily located away from your primary region, a note to that effect.
We will review within 5 business days. Geographic blocks are sometimes triggered by IP geolocation errors; those are easy to unblock.
7. Export-control compliance
By using Reservly, you represent and warrant:
- You are not located in, ordinarily resident in, or a national of any region listed in § 2 of this page.
- You are not on any denied-party, sanctions, or export-control list administered by the United States, the European Union, the United Kingdom, or the United Nations Security Council.
- You will not re-export, transfer, or provide access to the Service to any person or entity in an excluded region.
Violating these representations is a material breach of the Terms of Service and grounds for termination for cause.
8. Changes to this list
We may add or remove regions over time in response to law, sanctions, or operational factors. We will:
- Update the Last updated date at the top.
- Notify active Businesses based in a newly-excluded region at least 30 days before the exclusion takes effect, unless a shorter period is required by law or by an emergency sanctions designation (in which case notice will be as prompt as legally permitted).
We will not remove a Business from the Service retroactively for payments that already settled; we will help with data export and reasonable offboarding during the notice period.
